The client approached us with the spelling 'Poonchoo', and after our creative direction, refined the brand name and identity into what it is today.

Registrability Search

After conducting the preliminary screening, we vet two of your chosen names with our legal counsel to confirm the availability of the trade mark and advise in line with any possible legal concerns.

Trade Mark Registration

The registration process can start after receiving the legal go-ahead. It can take up to two years for the process to be finalised. However, you are protected for the full period as soon as the application is filed.

What is the difference between the TM and ® symbols?

The ™ and ® are used as notice of ownership for marks such as a name, logo, slogan, colour, or combination thereof. The difference is that the ™ symbol is used for trade marks that are not yet registered or are still awaiting approval. In contrast, the ® symbol is used for trade marks that have been registered successfully.

How long does the trade mark availability search take?

It can take up to ten days for the brand name or logo to be cleared.

When can I start trading with my new name?

You can start using your name as soon as it has passed the trade mark availability search. Although it can take up to two years for a trade mark to be registered, there is a good chance that the brand asset is well on its way to becoming yours once you have filed for registration.

Can I register a company before I start trading?

Yes. You can form your company by registering it and leaving it in a ‘dormant’ state until you are able to start trading.

Why is it important to know which trade mark registration classes my brand falls under?

Trade marks can be registered for various goods and services. All conceivable goods and services fall into one of 45 classes, and your trade mark will always be classified into one or more of these classes. This is done to ensure that your trade mark is protected in respect of all goods and/or services that it is used in. For example, the ADIDAS trade mark is protected in class 25, clothing and shoes, but it also falls in class 28 for rugby balls.

What can't be registered?

A trade mark cannot grant you exclusive rights to anything common in the trade or reasonably required for use. For example, "Window Cleaning Company" for a company that cleans windows is purely descriptive of the service provided by the company. Therefore, it would not serve to distinguish this company's services from those of a competitor. A trade mark also can't prohibit others from using your intellectual property in line with ways that won't lead to consumer confusion.
